Following this week’s UK Supreme Court judgement on deprivation of liberty, the Senior Judge of the Court of Protection, Her Honour Carolyn Hilder, has issued a “Note of Re X Judges”. It is a short checklist that summarises the key points to help judges decide whether a person is deprived of their liberty. The note says more specific guidance will follow asap.
